Tovak Terms and Conditions

By using the Tovak Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

1. Service Overview

Tovak provides an online platform that connects users with independent roadside assistance and towing providers (“Providers”).

Tovak is not a transportation provider, broker, agent, or insurer. We do not provide towing or roadside services and are not a party to any agreement between users and Providers.

All interactions, agreements, and payments between users and Providers are solely between those parties and at their own risk.

2. Eligibility and Registration

a) Eligibility

You must be legally capable of entering into a binding contract. If acting on behalf of a company, you confirm you have authority to bind that entity.

b) Accuracy of Information

You agree to provide accurate and complete information, including business details where applicable. We may verify your information and refuse access at our discretion.

c) Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use.

3. Use of the Service

You agree that you will:

  • Use the Service only for lawful purposes
  • Not misuse, disrupt, or attempt to hack the Service
  • Not copy, distribute, or reverse engineer the platform
  • Not transfer or share your account
  • Comply with all applicable laws and regulations
Tovak reserves the right to suspend or terminate access for violations.

4. Role of Providers

Providers are independent third parties. They:

  • Decide whether to accept service requests
  • Set their own pricing
  • Are solely responsible for service quality and legality

You agree to release Tovak from any claims arising from Provider services.

5. Payments

The Service is free for users unless stated otherwise.

Payments for services are made directly to Providers. Tovak does not process payments.

Providers determine pricing independently.

6. No Employment or Agency Relationship

Tovak does not employ Providers and does not act as an agent, broker, or intermediary. No partnership, joint venture, or employment relationship is created.

7. Indemnification

You agree to indemnify and hold harmless Tovak and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your interaction with Providers

8. Limitation of Liability

To the maximum extent permitted by law, Tovak shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or reputation.

Tovak’s total liability shall not exceed $1 USD.

9. Disclaimer

The Service is provided “as is” without warranties of any kind.

  • No guarantee of availability or accuracy
  • No guarantee of Provider service quality
  • No guarantee of uninterrupted operation

10. Intellectual Property

All rights to the Service, including software, branding, and content, belong to Tovak or its licensors.

You may not use or reproduce content without permission.

11. User Content

By submitting content, you grant Tovak a worldwide, royalty-free license to use, display, and distribute it.

You are responsible for ensuring your content does not violate any laws or third-party rights.

12. Third-Party Services

The Service may contain links to third-party websites. Tovak is not responsible for their content or practices.

13. Termination

You may stop using the Service at any time.

Tovak may suspend or terminate access immediately without notice.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law
